Legal note

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 of April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR) and with Law 34/2002 of 11 July on Information Society Services and Electric Commerce, the TOWN COUNCIL OF HOSTALRIC (hereafter referred to as the Town Council) informs that it holds the tax identification number P1708900D and its headquarters are located in Calle Raval 45 de Hostalric (Postcode 17450).

The Town Council is the owner of the websites www.hostalric.cat and www.turismehostalric.cat (hereafter referred to as the Town Council websites). These Town Council websites aim to provide the general public with information about the town, services, activities and promotions of the Town Council.

The content of the Town Council websites, including the texts, images, sounds, databases, codes and any other material, belong to the Town Council or to third parties who have authorised their use. The Town Council presents them on behalf of these third parties to inform and to facilitate their relationship with private persons and the remaining public administration bodies.

As a consequence, they authorise users of the Town Council websites to use this content for these purposes, to store information on their computers’ hard disks, to print it or to copy it to any medium. Overall, it is strictly forbidden to transform or alter this content, or to use it for commercial purposes, public communication or distribution or any other exploitation via any procedure.

The Town Council reserves the right to take the appropriate legal action to repair damages and prejudices caused by any act that breaches intellectual property rights. However, we remind that legal or regulatory clauses or texts corresponding to acts, agreements, orders or deliberations of public bodies that can be accessed from the Town Council websites are exempt from protection or intellectual property rights.

The official crest of the Town Council and other designs and logotypes that identify the Town Council or its bodies, services or campaigns and activities may only be used with express authorisation or prior knowledge of the Town Council. In any case, the use of the town crest is subject to the payment of the fee for use of plaques, patents and other similar characteristics of the town crest.

The modification, copying or distribution of the code of the pages is strictly forbidden without the express prior authorisation of the Town Council.

The Town Council shall strictly comply with current legislation on personal data protection and shall adopt the legally enforceable measures to protect the user’s personal data, preserving privacy and confidentiality.

The Town Council understands that when the formulas that appear on the Town Council websites are filled in, the user has been sufficiently informed of the purposes of the collection of their personal data and the purposes of the consequent data processing. Via this act, the user authorises the Town Council to process their data for the purposes expressed in each case and therefore authorise the incorporation of this data into their files or processing in accordance with Organic Law 15/1999 of the 13 of December for the Protection of Personal Data.

The user of the Town Council websites that provides personal data to the Town Council can exercise their rights to access, rectification, erasure or opposition, in accordance with the Organic Law for the Protection of Personal Data, by contacting the Town Council by any method.

The Town Council informs that the Town Council websites use cookies in some internal operational processes. These cookies allow the control of the user’s browsing data to make communication that is established between them and the Town Council’s website quicker and more comfortable. The validity of these cookies shall be limited to what is strictly necessary to provide services offered from the Town Council websites. Cookies shall never be used to acquire the user’s personal data. The user is able to configure their Internet browsers to obtain better knowledge and control over cookies. They can be notified prior to their installation and prevent this, should they wish.

The Town Council adopts the necessary measures and mechanisms to guarantee the security of the communication and transactions produced via the Town Council websites, according to the state of the technology and according to the type of transactions and services made available to users.

The Town Council can not completely guarantee that the Town Council websites and server are free from viruses and shall not be responsible for any potential damage or prejudices that may derive from inferences, omissions, interruptions, IT viruses, breakdowns or disconnections in the operative functioning of this electronic system, resulting from causes that are independent from the Town Council. Neither shall they accept responsibility for delays or blocks in the use of this electronic system caused by deficiencies or overloads of telephone lines, or overloads in the Internet access system, as well as damages that could be caused by third parties via illegitimate interference that is beyond the control of the Town Council. They do not guarantee the availability and permanent continuity of the Town Council websites and their services. Where reasonably possible, any interruptions to the operation of the Town Council websites and their services shall be notified in advance.

The Town Council reserves the right to unilaterally modify the presentation, configuration and content of the Town Council websites, as well as the service offer and the conditions required to use the Town Council websites at any time and without prior notification.

The Town Council shall accept no responsibility for the information that could be obtained via the links included in the Town Council websites.

Presentation of the content of the Town Council websites in a window that is independent from the Town Council is not authorised. The use of the Town Council websites implies the full and unconditional acceptance of the Terms and Conditions contained in this legal note. Potential conflicts related to the Town Council websites shall be exclusively regulated by Spanish law and the Autonomous Community of Catalonia. Any person who uses the Town Council websites, independent of the territorial jurisdiction that they are accessing from, commits to complying with and accepting this clause, expressly renouncing any other regional code of laws that could correspond to them.
